- Meet safely: public places, group walks first, and tell someone you trust.
- Listen to your body. FitSesh is not medical advice.
- Report anything that feels wrong. We can remove anyone who breaks these rules.
1. Agreeing to these terms
These Terms of Service ("Terms") are an agreement between you and FitSesh App LLC, an Indiana limited liability company based in Indianapolis, Indiana ("FitSesh," "we," "us"). They apply to the FitSesh website (fitsesh.app), the waitlist, and the FitSesh mobile app once it launches (together, the "Services"). By using the Services, you agree to these Terms and to our Privacy Policy. If you don't agree, do not use the Services.
2. 18+ only. No exceptions.
FitSesh is strictly for adults. You must be at least 18 years old to access or use any part of the Services, including the website, the waitlist, and the app.
- No one under 18 may create an account, join the waitlist, or use the Services, even with the permission or consent of a parent or legal guardian. Parental consent does not make anyone under 18 eligible.
- By using the Services, you confirm that you are at least 18 years old. Lying about your age is a serious violation of these Terms.
- We may ask you to confirm your age at any time, including by providing your date of birth, completing verification, or showing a government-issued ID. If you do not, we may suspend or remove your account.
- If we believe an account belongs to someone under 18, we will immediately suspend it, then permanently remove the account and delete its data. Anyone removed for being under 18 may not create a new account.
- Members may not use FitSesh to contact, message, meet, or arrange activities with anyone under 18.
- Children may attend an in-person activity, such as a stroller walk, only when they are accompanied and supervised at all times by their own parent or legal guardian, who is fully responsible for them. Children can never be members, and members may not bring children who are not their own.
- Profile photos must show you. Do not post photos in which a child is the main subject.
- If you believe someone under 18 is using FitSesh, report it in the app or email [email protected]. We review these reports first.
3. Who else can use FitSesh
In addition to being 18 or older, you must:
- Be able to form a binding agreement.
- Not have been convicted of a violent crime or a sexual offense, and not be required to register as a sex offender.
- Not have been removed from FitSesh before, unless we give you permission to return.
- Use FitSesh in compliance with the law.
4. Your account
- You may have only one account, and it must represent you. Use your real first name, your real age, and recent photos of yourself (up to 5).
- You agree to complete verification before meeting other members. Verification helps, but it does not guarantee that anyone is who they say they are or is safe.
- Keep your login and phone secure. Do not let anyone else use your account. You are responsible for activity on your account.
- Keep your information accurate and up to date.
5. Community guidelines
FitSesh is a friendly place for adults 18 and older of every background and fitness level, whether you're 18 or 80. When using FitSesh, you agree NOT to:
- Harass, threaten, bully, stalk, or intimidate anyone.
- Post or send hateful content, or discriminate against anyone based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, age, disability, body size, or fitness level.
- Send sexual content or make unwanted romantic or sexual advances. FitSesh is for walking and workout buddies, not dating.
- Shame anyone about their body, weight, pace, or ability.
- Pretend to be someone else, create a fake account, or use someone else's photos.
- Ask for money, promote scams, sell products or services, or recruit people for a business without our written permission.
- Share another person's private information, including their location, without their permission.
- Post anything illegal, violent, or that encourages self-harm.
- Use FitSesh if you are under 18, or help anyone under 18 use it.
- Scrape, copy, hack, or interfere with the Services, or use bots or automated tools.
6. Meeting in person safely
FitSesh helps you find people to walk and move with, but you are responsible for your own safety and your interactions with other members. We do not run background checks on members, and we cannot guarantee anyone's identity, behavior, or intentions.
We strongly recommend that you:
- Meet for the first time at a group walk or in a busy public place.
- Tell someone you trust where you're going, or use Share my walk.
- Get to and from the meetup on your own.
- Keep personal details, like your home address, private until you trust someone.
- Leave any situation that feels uncomfortable, and report it to us.
If you are ever in danger, call 911 first.
7. Your health: not medical advice
FitSesh is not a medical, health, or fitness service, and nothing on FitSesh is medical advice. Talk to your doctor before starting a new activity, especially if you have a health condition, are pregnant, or are recovering from an injury or surgery. Move at your own pace, and stop if you feel pain, dizziness, or shortness of breath. You take part in any activity at your own risk.
8. Walk circles and hosts
Walk circles are group activities, and many are led by volunteer hosts or community partners. Hosts must be FitSesh members 18 or older. Hosts are not FitSesh employees, trainers, or medical professionals. Locations are chosen by hosts or partners, and FitSesh does not own, control, or inspect them. Accessibility details for walk circles are provided by hosts and may not always be accurate, so please check before you go.
9. Your content
You own the photos, text, and other content you post ("Your Content"). By posting it, you give FitSesh a non-exclusive, worldwide, royalty-free license to host, store, display, and share Your Content only as needed to run and improve the Services, such as showing your profile to other members. We will not use your photos or profile in advertising without your permission. This license ends when you delete Your Content or your account, except for content others have already received, like messages, or copies we must keep for safety or legal reasons. You are responsible for Your Content and must have the rights to post it.
10. Reporting, blocking, and enforcement
You can block or report any member at any time. We review reports and may remove content, limit features, suspend accounts, or permanently remove members who break these Terms or put others at risk, with or without notice. We may also contact law enforcement when someone's safety may be at risk. You can report concerns in the app or by emailing [email protected].
11. FitSesh's content
The FitSesh name, logo, app, website, and design belong to FitSesh App LLC. You may not copy, change, or use them without our written permission, except to use the Services as intended.
12. App stores
If you download FitSesh from the Apple App Store or Google Play, you also agree to their terms. These Terms are between you and FitSesh App LLC, not Apple or Google, and Apple and Google are not responsible for the Services.
13. Changes to FitSesh
FitSesh is new and growing. We may add, change, or remove features, or pause the Services, at any time. The app is not yet available, and joining the waitlist does not guarantee access or a launch date.
14. Ending your account
You can delete your account at any time in the app (Your fit → Settings → Delete account), or by emailing [email protected]. We may suspend or end your access if you break these Terms. Sections 2, 7, 9, and 15 through 18 continue to apply after your account ends.
15. Disclaimers
The Services are provided "as is" and "as available." To the fullest extent allowed by law, FitSesh App LLC makes no warranties, express or implied, including that the Services will be uninterrupted or error-free, or that any member is safe, truthful, or compatible with you. FitSesh App LLC is not responsible for the conduct of any member, on or off the Services.
16. Limitation of liability
To the fullest extent allowed by law, FitSesh App LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of the Services or your interactions with other members. FitSesh App LLC's total liability for any claim relating to the Services will not exceed the greater of the amount you paid FitSesh in the 12 months before the claim, or $100. Some places don't allow these limits, so they may not apply to you.
17. Your responsibility to us
You agree to protect FitSesh App LLC from claims, losses, and costs (including reasonable attorneys' fees) that come from your breaking these Terms, Your Content, or your interactions with other members.
18. Law and disputes
These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-law rules. Before filing any claim, please email [email protected] so we can try to resolve it informally. Any dispute that isn't resolved informally will be handled in the state or federal courts located in Marion County, Indiana, except that either of us may bring a claim in small claims court if it qualifies.
19. Changes to these terms
We may update these Terms from time to time. If we make significant changes, we will notify you by email or in the app before they take effect, and we will update the "Last updated" date above. If you keep using the Services after the changes take effect, you agree to the updated Terms.
